Due to the content and purpose of the website, individuals seeking information must complete the contact form, while those wishing to make a booking must complete the User-Client registration form. By filling in the registration form, their data will be incorporated into an automated file protected under GDPR-EU-2016/679, LOPD-3/2018 (Digital Rights Guarantee), LSSI-34/2002 (Electronic Commerce), updated 09/05/2023, Directive 2011/83/EU on consumer rights, and Law 3/2014 of 27 March, amending the consolidated text of the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007, updated 29/06/2023).

4. BOOKING CONDITIONS

  • Full payment for the stay must be made upon arrival at the hotel.

  • Payment for additional services must be made upon departure.

4.1. CHECK-IN

Hotel access is available from 14:00 (2:00 PM).

The right of withdrawal or cancellation does not apply under Article 103 of Law 3/2014 in the following cases:

a) Provision of services that have been fully performed with the consumer’s prior consent and acknowledgement of the loss of the right of withdrawal once performance has been completed.
c) Supply of goods made to consumer specifications or clearly personalised.
l) Provision of accommodation services (other than residential use), catering, or leisure activities, if the contract specifies a specific date or period of performance. (Failure to appear on the booking date does not entitle the client to a refund).

8.2. CANCELLATION

The website administrator will only accept cancellations meeting the following requirements:

  • Cancellation must be communicated to HOTEL & SPA PIMAR at least 72 hours prior to arrival.

  • If cancellation occurs within 72 hours of arrival, the cost of the first night will be charged, unless the chosen room has a specific cancellation policy, in which case that policy shall prevail.

Early departure policy:
If the guest departs before the contracted check-out date, the total cost of the remaining nights will be charged, unless the chosen room has a specific cancellation policy, in which case that policy shall prevail.

The administrator accepts and processes cancellations under applicable local laws and EU Directives.


9. APPLICABLE LAW AND JURISDICTION

These terms and conditions are governed by Spanish law. For any dispute, the parties submit to the jurisdiction of the courts of Blanes, where HOTEL & SPA PIMAR is established, unless otherwise required by law.

9.1. ONLINE DISPUTE RESOLUTION

Pursuant to Law 7/2017 of 2 November and Regulation (EU) 524/2013 of 21 May, consumers may access the European Online Dispute Resolution platform.


10. PRIVACY POLICY

HOTEL & SPA PIMAR informs users of their right to access, rectify, object, erase, restrict, and port their personal data. These rights may be exercised by any means that provides proof of submission and receipt, addressed to the website administrator or by email to pimar@hotelpimar.com, together with a photocopy of ID or equivalent documentation verifying identity.

In accordance with Article 12.3 of GDPR-EU-2016/679, the controller shall provide the data subject with information relating to their personal data within one month of receipt of the request. Users may also lodge complaints with the relevant supervisory authorities (AEPD, ACPD, AVPD).
